The following conditions of sale are applied for any single order:
The goods travel at buyer’s risk and peril, even if sold free at destination.
Delivery date is not binding and can be extended by Ceriflex s.r.l..
Ceriflex s.r.l. cannot be held responsible for any damage caused by delays in delivery, for any reason.
Complaints are not accepted if not notified to CERIFLEX s.r.l. and recorded within eight days after delivery, by means of a registered mail, containing the specification of the defect itself.
Any complaints do not entitle the buyer to suspend payments, according to pre-established dates.
In any case, the seller’s liability cannot be higher than the value of the delivered goods.
Once ascertained the fault or defect, CERIFLEX S.r.l. has the authority to decide to repair or to replace the goods of the complaint.
The payment must take place at the CERIFLEX s.r.l. offices.
In case of payment delay, a late payment interest becomes effective, at the legal interest rate, increased by 8% points.
The exclusive place of jurisdiction for all disputes is where the CERIFLEX S.r.l. offices reside.
The missed or delayed execution of part of an order or of a complete order cannot be subject of refusal or complaint from the buyer.
The orders or any other agreement took by a sale representative or by an employee will be binding only when CERIFLEX S.r.l., with its unappealable decision, will accept them, sending an order of confirmation to the buyer.
It will be the buyer’s responsibility to verify the accuracy of his/her own personal data, and in case of errors or omissions, provide prompt communication, without which, those reported below shall survive. CERIFLEX S.r.l. shall be free of any liability or sanction.
No claim may be brought by the purchaser when the fabrics and products from him CERIFLEX S.r.l. provided, were cut and used for further production processing.
All specifications and products’ characteristics indicated in the catalogue are purely indicative.
CERIFLEX S.r.l.. reserves the right to change, without giving prior notice, the materials, the aesthetic attributes, the finishing, the colors, the details, the technical characteristics of the products, due to technical manufacturing and commercial causes, to errors/omissions of prices in the current catalogue and the relative price list.
The present terms and conditions of sale are governed by Italian law.
It is allowed a tolerance on the finished size of +/- 2 cm in length and width.
The price list could be modified without giving prior notice.
The prices are expressed for the public, in Euros, VAT excluded.
WARRANTY CONDITIONS
The CERIFLEX warranty is to be taken as a legal guarantee, as regulated by the Legislative Decree 2 February 2002 no.24 with the implementation of the EU Directive 1999/44, and it complies with
that pursuant to art.1519-bis to 1519-nonies of the Italian Civil Code, a specific paragraph entitled “the sale of consumer goods”.
The consumer will therefore be able to exercise those rights before the seller, in accordance with the terms and conditions provided for by the above-mentioned legislation and by the legal warranty.
The product has a warranty of two years from the moment of its purchase, in absolute accordance with the applicable legislation.
In any case, in order to make the warranty count, the person concerned must report the non-conformity, in writing, to the seller, within eight days from its discovery, under penalty of cancellation.
This warranty is not valid in all the cases of improper use of the product. The warranty does not cover dips of the used surfaces inferior to 2 cm, as such values are considered natural because of the settling of the filling under the pressure of the body weight (tolerance and measurements compliant with the standards European norms). Furthermore, the herewith warranty does not cover damages caused by negligence or careless use, such as failure to observe the use and maintenance instructions indicated on the mattress’ warranty, and maintenance or damages caused by transport, in other words the damages cannot be attributed to the product’s manufacturing and/or conformity.
In case of a report of non-conformities (faults), the company reserves the right to have a representative check the existence and the nature of the reported defect. Should the defect not be identified or attributed to manufacturing and/or conformity, the consumer shall be bound to pay the cost of the minimum charge in effect at the time. The territorial limit of this warranty is the territory of the Italian Republic.
OUT OF WARRANTY MATTRESS REPAIR: If the repair that must be done is not covered by the warranty (as indicated here below), on request of the customer and approval of the quotation, CERIFLEX S.r.l. will be able to provide for the restoration of the mattress, depending on the defects found attributed to the improper use of the mattress. The transport fees in case of return of the mattress to the company and its redelivery to the customer are met by the client, both in case of warranty replacement and in case of repair out of warranty.
